Ordering

Placing an order through this site is an offer to buy, which we accept when we send your confirmation email. Prices are in US dollars and tax is calculated at checkout based on your delivery address. We ship within the United States only at present.

We reserve the right to decline or cancel an order where an item is mispriced, out of stock, or where we suspect fraud. If we cancel an order you have already paid for, you get a full refund.

Shipping and delivery

Orders leave us as they come in, and you will receive tracking as soon as the parcel is moving. Delivery estimates are estimates: once a parcel is with the carrier, its timing is not something we control.

Risk of loss passes to you on delivery. If a parcel arrives damaged or does not arrive at all, tell us and we will deal with the carrier ourselves rather than sending you to do it.

Returns and refunds

You have 30 days from delivery to return the device for a full refund of the purchase price. It may be used. You do not need the original packaging, and you do not need to give a reason.

Email us to start a return and we will send instructions. Refunds go back to the original payment method within about ten business days of the device reaching us. Original shipping is refunded; return shipping is at your cost unless the device arrived faulty or damaged, in which case we cover it.

The one-year limited warranty

For one year from delivery, we warrant the device against defects in materials and workmanship under normal use. If it fails in that period we will repair it, replace it, or refund it, at our discretion, at no charge to you.

The warranty does not cover:

  • normal wear to the fabric, elastic, clips or finish;
  • damage from submerging the modules or the battery in water;
  • damage from a machine wash with the electronics still in the garment;
  • damage from dropping, crushing, unauthorised repair or modification;
  • gradual, expected decline in battery capacity over time.

This warranty is offered in addition to your legal rights as a consumer, not instead of them. Nothing in these terms limits any right you have that cannot be limited by law.

Using the device safely

Petal & Mom is designed to support milk flow and ease breast discomfort during breastfeeding. It is not intended to diagnose, treat, cure or prevent any disease.

It is not a substitute for medical care and it is not a treatment for mastitis. Mastitis sometimes requires antibiotics. If you have a fever, spreading redness, or breast pain that is worsening or not improving, contact your physician, midwife or lactation consultant rather than waiting.

Stop using the device and seek advice if it causes pain, if your skin reacts, or if anything about how it feels seems wrong. Do not use it over broken or infected skin, do not use it while asleep, and follow the care instructions: electronics out before the garment is washed, and never submerge the modules.

Limits of our liability

To the fullest extent the law allows, our total liability arising out of or relating to your purchase is limited to the amount you paid for the device. We are not liable for indirect, incidental or consequential losses.

Nothing here excludes or limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Governing law and disputes

These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these terms or your purchase will be brought exclusively in the state or federal courts located in San Francisco, California, and you and we each consent to the personal jurisdiction of those courts.

If any provision of these terms is found unenforceable, the rest remains in force.

Changes to these terms

We may update these terms. The version that applies to your purchase is the one published when you placed your order, and the date at the top of this page shows when this version took effect.
